Try Rats Day 1, Alesso, Hoxton Breakout Day 2.
So far, it seems in all attempts, he appeared when tested, just at a rather inaccurate time and not on all heists (as he need quite a bit of space with his 12 shields around him and due being stationary, should stay at a location where he matters)
On the two tests I was part of personally, it took about 8 minutes on Alesso, about 13 on Rats for him to spawn.
In addition to what Bindal said, I played like 5 levels today, he appeared on all.
I'm pretty sure he's guaranteed on DW.
He also locked assault to Fade Phase so only cloakers spawned. Very nice.
Different time periods with one being 22~ minutes and the other 26~ minutes. He announced himself both times during the final "Defend the Operations Room" objective before you grab the server to escape. Not sure if that's just odd timing or assured spawning. Both with bots.

No, it seems that the 5% are just complete made up bull by people that - as stated before - played heists where he can't spawn anyway.
