The FTC are on your side, as consumer protection advocates, what this poster said is absolutely true.

It can be proven that people bought it to support a developer that said there were no plans for any microtransactions, yes. Much in the same way some people suggest that we vote with our wallets, while its a good idea, it also needs to be followed up with consumer protection advocates like the FTC. It can be shown it was now misleading and dishonest on Almir's part.

I, SUMMARY
Certain elements undergird all deception cases. First, there must be a representation, omission or practice that is likely to mislead the consumer.4 Practices that have been found misleading or deceptive in specific cases include false oral or written representations, misleading price claims, sales of hazardous or systematically defective products or services without adequate disclosures, failure to disclose information regarding pyramid sales, use of bait and switch techniques, failure to perform promised services, and failure to meet warranty obligations.5

Second, we examine the practice from the perspective of a consumer acting reasonably in the circumstances. If the representation or practice affects or is directed primarily to a particular group, the Commission examines reasonableness from the perspective of that group.

Third, the representation, omission, or practice must be a "material" one. The basic question is whether the act or practice is likely to affect the consumer's conduct or decision with regard to a product or service. If so, the practice is material, and consumer injury is likely, because consumers are likely to have chosen differently but for the deception. In many instances, materiality, and hence injury, can be presumed from the nature of the practice. In other instances, evidence of materiality may be necessary.

Thus, the Commission will find deception if there is a representation, omission or practice that is likely to mislead the consumer acting reasonably in the circumstances, to the consumer's detriment. We discuss each of these elements below.

There was also supposed to be a 250,000 dollar prize tournament during paydaycon, which was paid for during the hype train event. The event never happened. Nothing is known as to what happened with this money. FAQ:

1) Isn't Overkill from bum♥♥♥♥ nowhere in Europe? 1A) Yes, but OVK/Starbreeze has an office in LA, in the USA. The Federal Govt has jurisdiction to look into this.

2) But it isn't a binding contract! 2A) See above. False advertising does, imo, cover this.

3) But I'm not from the USA. 3A) It doesn't matter. The FTC will still look at your complaint. Also, there are other consumer protection agencies for other countries, complain there if you are from those countries.

4) Trolling responses. 4A) Thanks, its only more motivation for me.

5) Don't bother. Overkill/Starbreeze are covered 5A) It still falls under false advertising and potentially fraud.

6) You're going too far. 6A) Nope. I disagree.

7) What will it take for you to stop? 7A) A full refund for myself and anyone who wants one.

8) Are you trying to sue overkill?! Don't do that! 8A) This isn't a lawsuit. This is a long term headache for Overkill and an incentive to get them to do something very specific.

9) Drills now drop 9A) The drop chance is less than 1 percent. Take that for what you will, but it heavily incentivizes buying drills, which they promised they wouldn't do. This leads one to further conclude that they did this knowing they made that promise. They added drill drops begrudgingly, and spitefully of their player base.
