Skills don't work like perk decks. If you have the skill points you can get the skill, no strings attached. The only limitation to getting skills is your skill points (obviously) and the tier its in. In order to unlock higher tiers you need to spend a certain amount of skill points in the subtree (the amount is displayed next to the skills in that tier) this number can be reduced by getting infamy skills. Other than that you can do whatever you want with your skills, no matter what tree it's in. The trees are only there to organize the skills, you don't actually select a tree. All skills will be active until you get reset them, select a different skill set, or go infamous.
To answer the perk question, the perk deck upgrade will only be active when it's completed. You know it's completed when it's glowing.
