They're not military, as the military cannot operate in the United States as civilian law enforcement under the Posse Comitatus act.
So really, I think they're just a super secret government paramilitary unit that skirts around Posse Comitatus.
I don't believe it's due to copyright. I think it's because in certain "scenarios", or what have you, such as video games like Payday, they can't use government entities like the real FBI (Federal Bureau of Investigations). It's the same reason why in GTA, it's the FIB (Federal Investigations Bureau), not the actual FBI.
