Once Human - band from Los Angeles
I didn’t know before the game that it turns out there was a musical metal band with the original name Once Human from Los Angeles. Therefore, i am interested in the question: what is the situation with copyrights to the brand name - Once Human. A group with a similar name was created long before the game. So if they start to figure this out, the developers may have to change the name of the game. Who knows anything about this?

The thing is, the game is not a band. So you cannot confuse one for the other. So copyright issues are really a moot thing.

Also Once and Human are common names. Like Sky was unable to block No Mans Sky even though they created the brand name decades before. The band won't get anywhere trying to fight this. Copyright only really works with unique names.

Copyright does not cover band names. It only covers the output, like songs, videos, books etc. Trademarks cover names and branding. In order for a band to sue the game devs they would have to prove that it makes it hard to differentiate between the band and the game, which is not likely going to happen at all. No reasonable person would see one and thing its the other. It would only become an issue if another band tried to use the name....then it would have to be proven who used it first. The game and Devs are safe. (I spent the last 20 years in the music industry and have dealt with similar issues from both sides in the past).

If there was a "game" called exactly "Once Human" there would be a copyright issue, and they couldn't even publish the game. There wasn't so no issues.

Thanks guys for the answers!

Just started looking for some cool songs from the game that are playing on the radio and accidentally found out about the metal band Once Human. And it became interesting that the names are similar. Therefore, the question of trademark, brand and name arose. I remember there were problems with the name of the game The Day Before, there was a lawsuit, but that’s a different topic))

In any case, thank you all for the clarifications and feedback.
