Nintendo did not develop it, they only published it! Developer was Silicon Knights. Source code and game is property of Konami even if Silicon Knights developed it for Nintendo platform. So Konami can do whatever they want with source code and port it on any platform.
There are few nintendo related posters in Otakon room that may be problem with copyright, but its easy to solve by replacing these textures with ones from PS1 version but upscalled or redrawn.
Also if there are other terms of agreement between Konami and Nintendo they can always make a new deal, and most likely old agreement is already expired and Konami free to do anything they want with Twin Snakes.
So far, the Vol 2 leaks are MGS4, MGS5, MGSPO, MGSPW and MGRR. Twin Snakes is the only major entry not in there.
Mem card dialog isn't going to show up during gameplay anyway. It's just a matter of Konami being willing to pay Nintendo for the right to use Nintendo consoles and characters in one room and since Konami are apparently paying good money for all the licensed stuff in MGS4, Twin Snakes is possible.

If they decide to make it so Vol 2 has Twin Snakes as a Switch bonus, I'm actually all for it.
Based on what's leaked, it's Portable Ops, Guns of the Patriots, Peace Walker, Rising, Ground Zeroes and Phantom Pain. Twin Snakes is literally ALL that's missing there. (And I guess Ghost Babel and the Acid games but let's assume that Ghost Babel is a bonus for buying the whole collection and the Acid games come in their own collection.)
But I did hear that Twin Snakes was considered for MGS HD Collection so it's likely that Konami can just pay Nintendo what they want since that's what stopped Kojima himself from remastering it in the first place.
Hmm, interesting. The game gets a lot of crap, and in some respects rightfully so. It is still a great game though.
