30fps cap?
Is there a 30 fps cap and upscaled resolution or is there something in the settings I'm overlooking?

The game is locked to 30 FPS by default.

You can unlock the framerate in DSFix, but going 60 and beyond makes the game pretty unstable: You'll likely fall through ladders, elevators, and other magical things.

dsfix has a hotkey to switch between 30 and 60 fps on the fly, no reason not having it if your pc can handle 60 fps.
And yes, the 1080p resolution by default is an upscaled 720p or something... use dsfix to make the game render in actual 1080p and also enable other neat stuff like antialiasing, ambient occlusion, hud modifications, texture mods... and other things. Just read the readme.

yes, backspace by default, but you can change it via dsfixkeys.ini

I'm thinking of getting this game, because i want to experience Dark souls, but don't want to pay a huge price for the newer ones.....but i don't like 30 fps gaming. so is this worth it? will the dsfix 60 fps make the game unstable like above said? or should it be just fine?

This was a huge-ass necro, ♥♥♥♥♥♥♥♥♥, but to answer your question.

Sure, its worth it. DSFix is simple to install and use, especially if you have experience with this sort of stuff.

The game runs perfectly fine at 60 fps, with a few issues:

1: There are two ladders in the entire game you cannot slide down. If you do, you'll fall through the world. Honestly not that awful, since again, its only two.

2: Your jump and roll distance is shortened. Annoying, but bearable. All developer-intended jumps are still perfectly doable, but some become extremely precise.

3: Framerate can be inconsistent. Certain areas/attacks have a tendency to shred your framerate, so something to keep in mind.

And as once again stated above, you can switch between 30/60 fps through a hotkey you can set up for any jumps you may do, so even that can be circumvented.

So its worth it, if you can handle a few bugs, and somewhat frequent dips below 60, more prominently in specific areas.

I played it with dsfix and didn't have any issues, can't speak for everyone though. could always give it a try and refund it if it isn't to your liking

What a dishonest comment. There is literally one ladder in the game that will glitch out with 60fps, and even then it's only if you slide down it.
