As for your second question, it's not a personal claim. Your character does not have a claim on that county personally--he has a claim on it because he is the Duke of the De Jure territory it is supposed to be a part of. Think of the Duchy as an entity separate to your character--it is the duchy that has a claim on that land, as that land is supposed to be a part of it.
Regarding declaring war, his liege's liege is also mine (I'm same level as his liege). So if I declare war to his liege, his liege's liege (which is also mine) will be in the position where he will have to chose between his liege and I. Or will he always protect the defender ? What criteria will make our liege to take party between us ?
