As the actual Byzantine emperor I don't believe that you can get the Reichskrone, unless another character first forms the Holy Roman Empire and you "acquire" the crown from them.
This guy has a screenshot of him getting crowned as Byzantine Emperor
Did he destroy the byzantine empire and then recreate it?
From what I can tell, he inherited the Byzantine Empire or cajoled himself into a top candidate spot for the Byzantines while playing as the Karlings
We're mixing up a few different things here. To get the Byzantine Empire onto another form of succession the title has to be destroyed, then recreated. When it is recreated it will copy the laws of your primary title.
Note that it must be created the regular way, not through the Intrigue decision to restore Byzantium. The decision will always impose Byzantine elective succession.
Creating the title the regular way is a bit more restrictive. The decision is open to all Christians and Hellenic, but creating the title the regular way is only open to Orthodox and Hellenic.
The restriction regarding creating new empires is tied to imperial government, not to any title itself. Imperial government only applies when you have either the Byzantine or Roman Empire title, and are on Byzantine elective succession.
So if you create the title normally with another succession law, you will have regular feudal government instead of imperial government, and not have the restrictions associated with imperial government. :)
