to usurp a kingdom, you must already hold more than half of its de jure provinces. when you usurp the title, the other parts of the kingdom that you don't control yet will become independent. but since they are de jure part of your kingdom, you have a de jure CB against them, so you can gobble them up without fabricating more claims. independent counts within you de jure kingdom will also often accept peaceful vassalization.

if you have a claim on a kingdom, you can press that without having any territory inside it. and you gain the kingdom with all of the vassals below it.

Then the best solution will always be to claim it and not go to war.

My problem here is just thst the AI player has a neverending rebellian war going on and I cannot usurp anything when his in war.

Yet I need to take the territory before I die unless I will loose both claim (usurp as well as by war)

Are you part of the same realm as the person you are usurping the title from? If not, you do not actually need the claim and you will not lose the ability to usurp the kingdom unless you lose enough territory in the succession that you fall below 50% of the de jure counties in the kingdom.

Well then the claim is only a factor if you plan to press it through war. You can lose the claim on succession and still usurp just fine once they are at peace.

When an unlanded courtier dies, his artifacts are inherited by his liege (with 50% chance of being lost). I've seen people say that this is only when they have no living relatives, but they probably have it confused with inheriting gold. I've inherited the iron crown of lombardy many times by unlanding the king, inviting him to court, and then killing him. BTW, the iron crown is indestructible so you can't lose it on inheritance.
