So, did they really lose? Not really. Nexon's goal wasn't to inflict pain, it was to eradicate Ironmace as a warning to any of their other employees from trying to leave and form their own startup. They didn't get a fine large enough to do that, they didn't get ownership of Ironmace or DaD, and they didn't win the copyright battle either.
6 million is nothing to a company like Nexon, and if anything the fallout from the lawsuit has lost them a good portion of market share from any of their future products.
This was a stupid endeavor for Nexon to pursue and people will remember it for a long time.
Court ruled there is no copyright infringement or IP theft, so that's a massive, uncontested W for IM that makes nexon eff off after this case.
They lost on trade secrets part, which seems weird to me, given how nexons own version of the game never left concept stage and fantasy DnD classes exploring dungeons for treasures and fighting monsters is most generic DnD thing ever.
Source on Criminal Litigations and people going to prison?
“Alongside the civil lawsuit, Ironmace and its associates have been referred for charges of trade secret misappropriation, copyright law violations, and breach of trust.”
"Nexon claimed, “They organized the project and created a similar game,” and filed both civil and criminal lawsuits simultaneously from last year"
"The ongoing criminal case by the prosecution may also influence the civil case depending on which charges are acknowledged. "
Though in the event they did go to jail, you know what would happen? We'd probably get better balance.
Unironically if SDF went to jail and someone else took over balance decisions the game would probably be in a better state.
That was basically just the legal concession prize to Nexon for being a big corporation and existing. In South Korea the courts always bend the knee to the big corporations. I doubt anything else will happen.
The third party used to investigate both claims of trade secret manipulation as well as copyright infringement determined there was not enough evidence for either claim, and recommended the court not pursue either charge.
The court did regardless, despite lack of evidence, because that's how courts in South Korea work. They don't have to prove anything to pass judgment. They are biased. Heavily. Their government is extremely dependent on corporate Korea and does its best not to piss off any of the conglomerates. You can trust the findings of a third party more than you can trust the rulings of the court.
In the end though, this is likely as bad as it will get.
