How is this the devs covering themselves legally? Why not use the other (I assume original) design Tripod anyway? The fact they have a backup design is them admitting legal liability.
No, they have a backup design in case paramount DID have issues so they could switch it over and continue working hard on their cool game, this does not show any admitting to "legal liability"
They aren't using the backup Tripod because they don't have to?
He already stated in a LIVE Q&A that he will be talking to paramount very soon, and that most of the War of The Worlds content is under a public domain anyways. Which you can google, there are laws in place to protect people making war of the world content

The book is public domain, not assets from the 2005 movie.
I thought this game was an adaptation of that movie, why? Because they are using the tripod from that movie.
This game is an adaption of the genre, not specifically the 2005 movie. SOME of the design choices from the movie are similar, but they haven't been stolen or copied and pasted. These models and sounds were hand crafted by Raf himself
While the book may be public domain it may be worth noting that Paramount has owned the trademark[alter.com] on the "War of the Worlds" namesake for games since 2007 when they had originally planned to make a full game from the movie (though they only ended up ever doing a crappy side scroller in 2011 ultimately).
So the dev may want to come up with a new game name as well before any form of actual release.
Being hand crafted does not mean the designs are not stolen. if you hand draw the little mermaid characters from the Disney movie the little mermaid and then make a movie with them that's still stealing even though the little mermaid is public domain and you drew them yourself
