The guard upstairs was asleep and didn't see me. When leaving I was trespassing and another guard saw me and told me to leave which I did. Then I walked up to the head guard and he greeted me as a friend. Another guard ran over a picnic table and told me I was a thief and said I had to pay 52 groschen. I told him I'd never do it again and he said to return the item and he'd let me go. I never returned it because I ate it already and the game have me no option.

Sorry, but this system needs some work. How did he see me? What was I supposed to return? Why did the head guard not arrest me? Why would I pay 52 groschen for a loaf of bread?

I think it might have to do with what clothes you are wearing tbh. I had something similar happen I stole a bunch of stuff from a shop while I was really conspicuous and they just assumed it was me. You need to keep clothes on you that are just for stealth if you are going to steal I think.

I know what you mean. I stole some trinket that was sitting on a bench and made extra sure nobody was even in sight. Suddenly as I'm leaving I get a notification they are looking for me because I stole it. Makes no sense lol.
