Three times through and I have yet to side against the fleet, but the first time I told Delgado Mathis was useless so he got booted and later tried to take me out in the same way.
Which is the only way for him surprise attack you - he has to be removed from the fleet; before the player takes the Fleet down, otherwise he dies defending the fleet.
