For the last time, it's PATENT infringement. Gameplay and mechanics, not the designs.
I do agree the designs are similar and could have been the target at the start, but this is how things have gone, and Nintendo/TPC have chosen their path.

If they see any monster capturing game, they will look for any reason to sue and kill it off or just shut it down. It doesn't matter how small it is, because they will find a way, which is exactly what we see with this lawsuit.
It is pretty reasonable to assume it isn't either of those mechanics given they haven't sued the plethora of other Poketmonster style games out there. Also, Nintendo/The Pokemon Company are absolutely going to come out the victors, whether this case makes it to trial or not. Despite what anyone's opinion is on the matter.
