Nothing happened there either.
The devs followed all the rules in their country and Nintendo did not complain when it had opportunity to do so. Maybe read the comments from the owner of the company instead of whatever source of misinformation you're relying on.
They have forgotten / did not notify Steam about the usage of ai, which has to be done in the submitting process. Steam can either remove the game forever, or make an exception.
Steam will review the usage of ai and if it turns out it is against the TOS everyone will lose access to the game. Which seems a 30-40% chance.
So no need to get extremely worried, but you shouldn't be without any worries either.
