No it's not. Pokemon does not have the rights to dogs, dragons, and crabs and whatever other animal they resemble. Nintendo can't and won't do anything.
Gen 1 pokemons look almost identical to DragonQuest ones but with an emphasis on 'cute' rather than 'cool'.
Pokemon is literally a game of copying "what is popular", and hoping it'll be successfull, and it was.
Digimon did the same thing.
Quake did the same thing.
Zelda Breath of the WIdl, is the same, ♥♥♥♥♥♥♥ thing. It's just a Skyrim clone.

Gastly is a clear copy of Madusa from Dragon Quest.
Golbat is bascially just Dracky
Grimer (and by extention Muk) Is clearly just Liquid Metal Slime.
Hypno is pretty much Magus (and their dirivitives), but staff is replaced with the pendant.
Bedrill is pretty much Dragonfry.
