Your best bet is OpenGL, but you might use Direct3D9 just as good if you prefer.
If the patch you are mentioning is indeed an "unreal patch", then that patch is not for UT99, it's for Unreal only.
Unreal has a more advanced and up-to-date engine thanks to the efforts from a certain community member (the only one allowed to do so by Epic), so it's almost certain to work with any system, however UT99 does not benefit from the same goodies and support (although it's far more popular) and is stuck with the same old engine and renderers, so in order to be able to run it well you might have to do a fair number of patches and additions.
Right now it seems that your only problem is the fact that you're using an old render driver, so by installing a newer community made one, you should not only fix it, you will have much better performance and stability, besides the possibility to enhance the game with more visual settings and the proper support for high-resolution textures (S3TC).
Firstly I tried OpenGL, but fps are lower than 60. Direct3D9 is the best option for me, brightess option is working and there's 60 fps.

Replace the following lines in section [Engine.Engine] in "UnrealTournament.ini"
Replace "GameRenderDevice=D3DDrv.D3DRenderDevice"
With "GameRenderDevice=OpenGLDrv.OpenGLRenderDevice"
