My only guess is he’s claiming fair use or something, arguing it’s transformative, but I have no idea if that would hold up.
Repackaging someone else’s work with some tweaks seems really dodgy.
Part of the reason the biggest switch emulator died was exactly because they were charging money for access to builds, which drew even more attention to them.
I really didn't like it when I saw people saying it was a paid mod, that's a horrible practice. Curse Bethesda for ever pushing that through. However, it says this on their Patreon:
"Why your support is important? By becoming a Garden of Eyes patron, you will support the development team behind the creation of the content, and gain early access to the content we create and become part of the creation process, which will be released for free when completed! I am deeply humbled and grateful for your support and generosity, and your support would greatly help me to keep creating more content!"
So, the mod will in fact be free once finished, you're only paying for early access and the opportunity to influence development which is fine, in my opinion.
