TOS only applies to play on the official servers. Playing offline cannot result in a ban.
Normal rules about playing mods offline and making sure they are removed before returning online apply.
It triggers false positives in some low-quality malware scanners. NexusMods make sure all the content uploaded is safe before accepting it on their site. Same for trojans. Same for crypto miners.
Proceed at your own risk... sure. Your game might crash. That happens already with the unmodded version of the game. :D
It triggers several malware flags on a shoddy website that does the same thing for virtually any program you ask it to scan.
It's "suspected" to have a crypto miner in the same sense vaccines are "suspected" to have microchips; that is to say, it's a disinformation campaign by people who are salty the mod exists.
