Edit: the icon is the most visible indication, but it's simply tied to the small obelisks you can sometimes see. They're called Rebirth Monuments and when there's one near, you can summon.
So it is just a trash mechanic. Fun.
They don't have to have a *good* reason for why i can't use them but i would very much like a notice saying they can't be used. Something that stays onscreen or gives me a audio cue.
Something other than *fight starts, switch to summon* "oh joy not useable."
The summons also use the exact same AI as their living counterparts, including aggressiveness. Wolves for example aren't all too aggressive and spend a lot of time circling their opponent, their ash summons are no different.
Boss rooms often have summons enabled, I'd say maybe 90% of the time. You can sometimes lose some time with switching to summons and seeing that they don't work, but it shouldn't be a big issue most of the time.
If you can't see the grey icon you can't use them
Those are what designates an area as a summon zone.
This is primarily and most consistently boss rooms and ruined villages, though sometimes they're in other locations (usually for a world boss encounter but not always)
You can always tell if you're in a summon zone by the purple-white arch on the left side of your screen.
The rats though, they're pretty useless. Even with 5 of them they don't accomplish much, but they're free.
By death i meant i summoned them in a boss fight, died then came back after respawning to the same boss fight and found i was unable to summon them at all now.
As for using the summons i did treat them as just ways to share aggro, their behavior doesn't really bother me much as much as the fact that most of the time the game just says "no, i'm not in the mood for your summon that takes up inventory space and resources to upgrade."
Play wisely, don't blame the game.
