Yup - game omniscience is a bit extreme. and "The Law" is just stupid unfair.
The following is for SP.
For random acts, it does seem dependent on how well you are known in a given town/area. Killing all close witnesses and getting away quickly is very important, and very hard in a town. Clothing and horse are not as important as the game tips imply.
For certain quests, like shooting up a small town after breaking someone from jail (in a town you've never visited) or robbing a train full of tourists from New York, you will Always get a bounty. Obviously just part of the quest. (stupid, imo, but there it is)
In a fantasy story perspective, we can all rationalize why these things are true (to some extent), but the game omniscience basically makes it Not Worth It - since you can very easily end up with a bounty that exceeds your take And "The Law" Never Stops Coming
For example about "The Law", i killed all the town folks that wanted to stop me, and then "The Law" just kept coming... after killing 7-8 waves of "The Law" (50-60 of them, after 20 towns folk) i finally realized it was pointless - the game is basically designed to make it worthless (not worthwhile) to commit crimes in towns.
And robbing someone and leaving them alive is plain stupid (but it's what the game expects) - in stand-alone shops, shoot the shopkeeper, rob him and walk away - no one notices. But i don't know if he respawns, so hopefully you don't need anything from him in the future. :)
