I guess it was just easier for the devs to gloss over this part and let a cosmetic effect masquerade as a tangible disguise feature hoping our imagination would overlook the inevitable bounty.
It is what it is but a disguise should have some effect or crooks simply would never have bothered with this thought out all criminal history.
If you are quick enough however OP or deal with the witnesses one way or another you can get away with your crimes....or make things worse.
The npcs remember seeing your horse and clothing if you been using it for extended period of time...
It's insane.
My guess is because the idiot Bill, or one of the other fools you ride with, keeps calling you by name during the whole crime, as well as shouting "WooWee Arthur Morgan, that was one hell of a shot you made, killing that there young deputy".?
Even animals smell you and run away
