And SNK neo-geo games sold on steam come bundled with bios files, so I assume it's perfectly legal to run them through 3rd party emulator.

I think what they mean is supposedly the MegaMan collection games were effectively re-written from the assembly code so that they're actually native executable files using a new engine, instead of ROMs running with an emulator: https://www.gamasutra.com/view/news/251956/How_Digital_Eclipse_aims_to_preserve_classic_games_for_future_generations.php
I haven't seen anything that would suggest such an undertaking actually occurred, and I wouldn't be surprised if what they really did was just build their own emulator and wrapped the bare ROMs inside it.
That is a custom emulator and as already said the prg and chr roms are separated, but it is emulation, not a port.
