I've been looking for a comparison between the E3 2018 gameplay trailer and what's ingame, and it turns out someone made exactly that. So, to those with an open mind, have a look and judge for yourselves.

Why does 2018 footage have watermark of, does not represent final product, but why is this obscured with the YT's own title?

It is totally okay it's marketing 101 and yes, you can get sued for lying as a company. but in a lot of cases you still end up earning more than you lose. But the real problem lies another place. It's us as consumers thats the problem. we eat it up and keep asking for more by pre-purchasing games. So unless you directly have to power to change the consumer habits, you won't change a thing.
personally i don't feel cheated at all. had plenty of time to refund or do research on the game, and i still ended up buying the game and had my fun with it. and propably more fun if CDPR doesn't get shredded in the meantime and actually get the game fixed.

They broke records of pre-order sales, this tells you more about the consumer when "buyer beware".

The 2020 version seems to only be graphically improved. The majority of the other things look better in the 2018 version.

again, what can you do. the fact that people don't care and unironically stand up for the studios shows that consumers have been demoralized to this. It's the "new normal".

For what ever reason, it still releases them from any legal obligations, because that's what disclaimers are there for.

Of course it looks better - wouldn't want the fans thinking they down-graded like with Witcher 3. They made sure of that. But that's not the problem with the game. :D
