We probably won't really know for sure until Microsoft says anything, they have been notably quiet.
Given Sony's strict "no refund policy" I believe this.
Speculation is CDPR said refund and ask Sony.

Sony has their own refund policy and due to the influx of requests, they likely said.. fine. Have your refunds and gave the game the boot from their store.
It says "Our discussion" implying that both parties are FULLY AWARE of the issues.
The final decision goes to SONY. The point is that CDPR communicated with SONY and both had the same in mind. The game was not pulled arbitrarily.
