when i origanally started the game back up everything needed to be updated and i updated because the performance was bad so the first itteration of this issue was with the older drivers. i dont know if this counts

Yes, frame rate drops in Dogtown, it's a bit heavier on both CPU and GPU in areas, drops to 40's but still within VRR range so fine with me.
I did tweak DLSS profiles over the weekend to slightly increase the resolution performance mode upscaled from for just a little more clarity out of it without the hit to performance that shifting to balanced mode incurred (with success, 55% instead of 50% - or 1422x800, for those that may want to try it in DLSSTweaks).
