The issue is that Rivatuner hooks into the executable. Anti-cheats look for that because that's what cheating programs do. Doesn't matter what program it is. They are not going to exclude rivatuner, because you can design a cheater program to look like rivaturner, or whatever exclusion the anti cheat has, and get away with it.
Programming is fun isnt it?
You SHOULD be able to appeal any action taken against your account, because I assume that battle eye makes a log of the violation. So if you do get banned, don't be a child about it.
I've been dealing with crashing aswell. Something interesting is that it only happens after tabbing-in to the game, in case it might be something else.
If you want FPS display then enable ingame fps monitoring.
I use MSI AB only to monitor other esenciall stuff, and it runs just fine in the background
on my oldies Logitech G19 lcd display.

essentially, until Bungie figures out the kinks (if they can), disable as many 3rd party programs as possible to see if it fixes your crashing
Which is funny since something like cortex is supposed to boost performance, taking up less space from your cpu/gpu.
