Some of the high caliber infantry guns do hit throught the tree with reduced effects. (Especially if you're just next to the tree)
Also, even if you double-checked out of 3rd view perspective, that doesn't mean he doesn't see a elbow or a feet. Unless you could review its killing shot from its perspective, you might not see him as being able to look at you while his position and degree of vision could see even just a small bit of you. (That, for an AI, is as big as a truck to shoot. This game isn't something like Metal Gear Solid where a soldier doesn't even see an arm hanging next to a corner and does nothing. All they need to see is a single "face" of your character collision box to shoot you.)
In other words, only try to use trees as cover if you REALLY have nothing else and might be under fire. Don't use them to hide from their field of view or even from their fire.
Thanks for the in-depth analysis. I suppose I was just being over-confident thinking that because I appear to be fully behind a tree, the infantry firing on me shouldn't be able to damage me.
This certainly clears things up, though.
