The consumers fails to win in more than 90% of all those cases. Why? in MMOS, The ToS are different.

People have things that they pay for taken away all the time and as you said usually lose the case if they protest.
Why do people not have to follow rules because it's a game? Where is the line drawn ?
How hard is it to follow rules you check a yes box to, whether in a game or not.
