Being racist is not a crime though
One simple reason is that it makes knowing what an enemy is very easy, cause solid blacks are very rare in nature. In contrast to making them all green or brown. Aso it makes them harder to spot at night, which makes nighttime even more dangerous. I think its intentional that the grey humanoid statues and the enemies blend together at distance, so you need to double check a bit.
Another thing is that it makes making the models easier, cause you pretty much don't need to texture them.
More of an issue is that all shooting enemies blend together besides the police ones and doing the paparazzi missions becomes a pain (also cause seeing through the camera is almost impossible). Rest is still easy to distinguish from each other, so thats good.
So yeah, this is pretty much it from a design view.
