Thanks, sent a complaint. They have two weeks now to restore the music, otherwise a civil lawsuit will be brought against them by me!
Rockstar has a EULA. It's legally binding worldwide. You agreed to it the second you booted up the game.

Please inform yourself about German law. First of all, the EULA is not legally binding here since it was not provided prior to the purchase.

I know nothing about the German BGB but if Sachmangel is anything like "buying something that is so faulty that it prevents its regular usage" then the situation is totally not like that because the game still works as it should.

Well, it does not work fully as it should since those songs are removed.
In accordance with §§ 434, 437, 438, 439 BGB I asked them to restore the songs and gave them two weeks to do so. If they fail to comply, that is enough ground for a lawsuit against them.

If that regulation as anything like what we have (and it should be because cvili law in my country is heavily influenced by the German BGB) then as a criteria the fault has to be serious. Missing a few songs is nothing serious because the game absolutely functions how it should without them, also when it comes to software you as an end user can use a previous version so your "right to use" is fully intact.

(1) Die Sache ist frei von Sachmängeln, wenn sie bei Gefahrübergang die vereinbarte Beschaffenheit hat. Soweit die Beschaffenheit nicht vereinbart ist, ist die Sache frei von Sachmängeln,
1. wenn sie sich für die nach dem Vertrag vorausgesetzte Verwendung eignet, sonst
2. wenn sie sich für die gewöhnliche Verwendung eignet und eine Beschaffenheit aufweist, die bei Sachen der gleichen Art üblich ist und die der Käufer nach der Art der Sache erwarten kann.

Zu der Beschaffenheit nach Satz 2 Nr. 2 gehören auch Eigenschaften, die der Käufer nach den öffentlichen Äußerungen des Verkäufers, des Herstellers (§ 4 Abs. 1 und 2 des Produkthaftungsgesetzes) oder seines Gehilfen insbesondere in der Werbung oder bei der Kennzeichnung über bestimmte Eigenschaften der Sache erwarten kann, es sei denn, dass der Verkäufer die Äußerung nicht kannte und auch nicht kennen musste, dass sie im Zeitpunkt des Vertragsschlusses in gleichwertiger Weise berichtigt war oder dass sie die Kaufentscheidung nicht beeinflussen konnte.

The new patch violates point 2 here. Especially the list of songs included was known.

Material defects

(1)The thing is free from material defects if, upon the passing of the risk, the thing has the agreed quality. To the extent that the quality has not been agreed, the thing is free of material defects

1. if it is suitable for the use intended under the contract,

2. if it is suitable for the customary use and its quality is usual in things of the same kind and the buyer may expect this quality in view of the type of the thing.

Quality under sentence 2 no. 2 above includes characteristics which the buyer can expect from the public statements on specific characteristics of the thing that are made by the seller, the producer (section 4 (1) and (2) of the Product Liability Act [Produkthaftungsgesetz]) or his assistant, including without limitation in advertising or in identification, unless the seller was not aware of the statement and also had no duty to be aware of it, or at the time when the contract was entered into it had been corrected in a manner of equal value, or it did not influence the decision to purchase the thing.

(2)It is also a material defect if the agreed assembly by the seller or persons whom he used to perform his obligation has been carried out improperly. In addition, there is a material defect in a thing intended for assembly if the assembly instructions are defective, unless the thing has been assembled without any error.

(3)Supply by the seller of a different thing or of a lesser amount of the thing is equivalent to a material defect.

its not THAT easy in germany or europe....a EULA or TOS is not allowed to handicap the customer or his rights also steam sells "licenses" but it looks like it sells the game...german courts have told that if its not 100000000% clear from the front page thats its not a classic copy where you buy the game and just a license...the company cant say "HEY ITS JUS A LICENSE" the custome has rights like he bought the game what ever some TOS EULA things say...

BUT....why writting it here someone rly believe Rockstar support or who ever from them is reading here?they never show up and said HELLO...in none of there steam games....
