Miller v. California is still the current legal standard and used in literally every case involving obscenity claims to this day. It's how the Miller test was named.

1. It was from the 1970s.

2. It concluded that intercourse was not patently offensive, but that homosexual fellatio and transsexuals were offensive on their own.

3. The court also refused to allow the defense's public opinion surveys which showed it was not patently offensive to the average person.

4. Homosexuality is no longer stigmatized like it was in the 70s.

My entire argument from the beginning has been that Miller and most obscenity rulings are stupid and should be overturned rather than blaming the companies involved. You would know this if you actually read anything I said or had any intelligence. None of this changes the fact that Miller is still the legal standard.
