Can you get VAC ban for using cFosSpeed internet optimizer?

no i had the asrock version for awhile it's safe

It doesn't boost.

It simply gives applications higher network priority than others (either manual or automatic).

Typical of such, nothing that can't be achived safely and specifically through other means, without the need for installations, other processes and potentially unwanted software bundled alongside.
