I would love to even hear how you came to such a conclusion of claiming to know that this was the cause for a ban in the first place, but suspect it'äs because that's what you did a tthe time the ban was eventually applied.
VAC bans arte applied ONLY for the detection of known cheats detected ona device from which an account has logged on via STeam and conencts to a secure server.
Please familiarise yourself with the operation of the system, particularly regarding the delayed nature of VAC bans, and review your understanding of the definition of "cheats" whic you agreed upon with Valve within the SSA.

EDIT: FOllowing more information, it still stands that changing the refresh rate is not causing the ban. However, using third party tools which allow you to change the refresh rate is sufficient to warrant such a ban.
You knew this, because you've read & signed to have understood and accepted the policy statements and the SSA.

It seems the OP account may wel ahve been banned due to the use of unauthorised modding tools.
So if they manmaged to obtain some cheat tool to circumvent a cap placed on the game, it woudl be reasonable to expect a VAC ban for such. Especially given the extremely strict non-modding policy of CoD games.
Either way, sounds like a valid ban to me, nothing "mistaken" there.
