Why doesn't batman just kill the Joker?

Same reason why the main character can't ever connect with the love interest, and new characters can only remain for an episode or two before being killed off or leaving. It would alter the core formula and end the show. Completion ends and remakes the world. The show is predicated on that which already is remaining and its permutations traced out endlessly. This maims the mind.
he'd have to kill all the other criminals too.

it doesn't really seem like killing hitler is an express train to shooting hundreds of ss soldiers in the back, but it is.

joker's also pretty clearly a deranged mental invalid. he appears competent because society is just that dysfunctional, and he portrays that observation and understanding as meaningful. the way a robot would.

maybe ask why gotham keeps letting him go instead of executing him.

Part of it depends on the continuity. He did kill the Joker in the 1989 Tim Burton movie. You could argue it was an accident, but maybe not. Also, oftentimes the Joker doesn't do anything that's really worthy of outright killing him. A few bank heists where maybe the guards are knocked out with laughing gas isn't that serious of a crime.

But also Batman explains it himself numerous times. For one thing he respects the legal system, and it's kind of up to the judiciary system to figure out what to do with him. For another he has to keep his discipline to avoid becoming the sort of monster he seeks to fight. Batman without that sort of self-control becomes the sort of dictator seen in the alternative Justice Lords universe.

He doesn't want to play cop, judge, jury and executioner. His job's done at the cop stage.

I think I vaguely remember reading that Batman saved The Joker from having the death penalty enacted upon him though. I can't explain that if it happened.

I barely watched any of these movies but from what my friend told me, "It would put Batman in a negative light and make the Joker a martyr. He would be not better than the Joker, in fact he would be worse".

You should watch the original series from the 1960's and you'll see why.
There is only one Batman...Adam West is Batman.
Yeah there's a good one where the Joker explains away Batman's offer to come with him. When he tells the joke about the two prisoners shining their torch beams over the prison fence. "You'll just turn it off when I am half way across" Or something like that.
