Depends on the region. Here in the states they're rated, "M", which has a recommendation for those 17 and up only, but there's no law in place. It wouldn't be illegal to sell an M rated game to a 13 year old, but most stores have a policy not to.
"AO" is the 18+ ESRB rating, but you very rarely see that. Most actual 18+ games don't even bother to get ESRB rated. When we hear "18+ game", we assume you are referring to pornography.
