Dude the law is the same structure and format. The law also considers sadistic material to be illegal as well. You can't record someone being murdered, raped, beaten, or brought to bodily harm, and post it except for reporting(and even then sometimes not.) Same legal standard. By this legal standard Saw would also be a snuff film. I don't care what the content is. NOTHING is worse than the act of murder, periods hand no down no questions asked, but we let it be depiction fictitiously, for good reason. I don't know why you insist on digging in this point that somehow murder is more acceptable to show than rape but you shouldn't ignore the point of the knock-on effects on fiction as a whole and the control needed to prevent material which appeals to one of the big 4 sexually based mental illnesses.
Same applies to a sub-section of rape and abuse, we let it be shown in fiction. And I listed several knock-on effects such as: barring fictional races with differtent biological development than humans; any character under California legal age(it's the only place with 18) like the 16 year old professional soldier I mentioned; character designs who simply looking childish(see Lucky star) or as simple as characters whose ages are listed inaccurately to their biological development(see Yoko Litner), all of these being banned.
