Pirate Old Games, Not New Ones
Since no one except the third-party resellers on Ebay make any profit on those games, the devs won't make money either way. If they made a port or a remaster of a game, I would buy it.

I don't know how all of these business shenenigans work, but I'm pretty sure no developer ever slept under a bridge because of people pirating their game.

I think this is true. Especially devs that no longer make money from games not being officially sold.

Still have to prove they arent my back ups. Which good luck with that.

If you are downloading the file, it's illegal.

It is illegal, but when the devs make no money from a game not being officially sold, who does it hurt?
Like, if I want an SD card of DS games, the DS is no longer being sold, the games are no longer being sold, the console has no support from Nintendo.
It doesn't really matter that the developer would not make any money from the sale of an old game disc via Ebay. You are acquiring the physical copy of the product, and ownership of the physical copy is transferred to you.

The use of the software or content on the disc may be subject to a license agreement though, but that is whole other level of complicated legal speak and it could vary depending on the terms and conditions of use for the particular product or game. To be fair nobody is checking where the disc came from and if you're the original owner.

Downloading the game however is completely different and I'd assume that in many cases it would constitute theft. The only way to be sure is to contact the developer and ask them.
I remember the time I moved into my first apartment and I asked my neighbor if I can use his wi-fi to finish up my college homework. I'm still using his wi-fi to this very day.
