Depends where you are. If your sitting on a piece of gym equipment, not actually using it and just staring at your phone, with headphones on so you don't want to be disturbed, it would be you that's being rude. I see it all the time in my gym and it's really annoying. It's supposed to be a gym, not an internet cafe.

Ever been waved off right in the middle of a conversation when talking to someone who is either wearing headphones or using a phone?

IMHO that's grounds for murder.

It's rude to talk to someone wearing headphones...
They are so small it can be hard to tell anyone is wearing them.

Then when they talk you think they are talking to you or something.

It really is a cultural thing that has come up only in the past few decades, this prevalence of always talking to someone even alone is odd for older folk and make for some awkward situations like waving and saying hi back thinking they are talking to you and they were just on their phone.

I'll probably die before I get enough practice in to just assume everyone is wearing ear pieces.

If you were initially weaing headphones and they attempt to talk to you, no. If you put them on during the convo then yes

Not if you wear custom in ear monitors paired with a dedicated player, DAC/AMP .

to me personally,i dont do this to a blind,
while we are talking about rude,being rude is like being polite,it is all a trick in social skill,to deal with people and situation.
i try to be polite,that is how i am taught,i try to be rude ,that is how i am taught,this is different than,using these social gestures for effect other than itself.
people use it all the time,i use it all the time.
accusing someone of being rude is also social skill.back and forth back and forth.
until,one day,you realize you cant hate a person because he is usually rude or usually polite.
and you see through his disguise of social skill.that is when you can develop real feeling towards others.

For blind people you are supposed to slap them up side the head once to let them know someone is watching them... it's the polite thing to do. That way they know to take the ear bud out or not.
I don't talk to people while they are listening to something. At work there are people who do that and when I need something I signal them with a hand wave. I feel bad every time...
