In one of the various comic "timelines" Batman does indeed kill Superman. Batman does the totally unthinkable and completely surprises Superman by pulling a gun and shooting him with a Kryponite Bullet. Not entirely sure since I've lost track with all the various off-shoots and timeline revisions.
Anyway, people often forget Spider-Man is incredibly smart too depending on which "version". I mean, there's one where he is basically Batman but with spider powers. IMO, Spider-Man's abilities + brains would make him beat Batman if it was a random encounter. "Spider sense" and reflexes/speed are just too good.
But, like others have mentioned, if Batman knows he is going to fight Spider-Man... Batman wins. That's literally Batman's superpower. He can straight up kill the entire Justice League. Ironically Static Shock was able to beat him and the Justice League.(though they were controlled by Brainiac at the time so one could argue otherwise)
I'm not exactly up to date with the comics, but isn't Batman Animated Series/Batman Justice League Unlimited the definitive version of Batman ?
Kevin Conroy is the definitive Batman just as much as Mark Hamill is definitive Joker. If we go by that version of Batman then NO - he does not KILL.

Well that's what i was saying in my post above.
It depends what version of Batman we take.
But just for argument's sake let's say Kevin Conroy and Mark Hamill are the definitive Batman and Joker. Then in that version of Batman, NO he does not KILL.
If it's in a Marvel comic, Batman wins. Spider-Man learns from his mistake, tries to fight again, it ends in a draw and they go get shawarma.
I think Bruce would just invite Pete to one of the restaurants he owns and then in the end he'd even offer him a job as a manager over there or something similar. LOL
Then he failed the job description of a Ninja which is assassinate people.
My claim still stands Batman is a crap ninja if that version never kills.
Batman's a tourist in the Marvel Universe. He owns nothing there.
Just because he REFUSES to kill doesn't mean he can't. He chooses NOT to do it. That still doesn't mean he CAN'T do it.
Bruce Wayne's a billionaire, he'd probably even buy Tony Stark's company if he wanted to. LOL

He has no capital in the Marvel universe. No bank accounts. No resources. No Wayne Enterprises.
That doesn't mean he CAN'T do it. He CAN but he refuses to because of his morales. He stands for justice and to protect the innocent. He won't cross his own code.
