There are games that will run through software on Non-Backwards compatible consoles but the list is VERY small.

It's very odd how Sony didn't add a whitelist for PS2 games for non-BC consoles since they still work fine even without the EmotionEngine chip.
It's not in the slightest.
Jailbreaking a console allows users with burnt optical drives to still play games instead of the console being an expensive paperweight, allows users to control the fan speeds in case the console overheats and most importantly ALLOWS USERS TO SEE THE CPU AND RSX TEMPERATURES which is a very important thing to have especially on fat PS3 models as the non-modified console has no temperature protection.
Regarding emulation, if you buy a NES/SNES/PS1/C64 mini you do know the games are running through an emulator, right?
Emulation by itself is not illegal at ALL. Sharing console code (BIOS) and games IS illegal. Get your facts straight.
