I seem to recall using a retail disc a while back on my Windows 10 rig.
As with some older games, you might benefit from downloading an older version of Direct X from microsoft:
The game expects to see a certain direct x on your system and it isnt installed on windows 10 by default.
This can cause issues in many older games so a download is required.
See here:

And you can always try installing or running the game in compatability mode ( xp or vista ).
Or, enabling legacy support in windows 10 control panel, windows features... i forget the exact menu, it helped me out sometimes though.
Also there are a few known general fixes on PcGamingWiki :

Plus if the Securom copy protection in the game gives you issues there are work arounds to be found for that as it may not "always" play well with windows 10.
Specifically though, since you would be using a retail disc presumably, it might not be an issue as the software checks for the disc anyway:

I would love to see a new Steam version and an Xbox One version of the game.
The reviewers on Amazon do.
Licensing.
Yes, It works just fine. I've also tried running it on low spec laptop with Intel integreted graphics and it works smoothly. The graphics are quiet decent for a 2009 and that too a Marvel licensed game!! I used the x...[livele]ss mod (a dll file that disables GFWL in-game). There aren't any issues with the game but I had to edit some .ini file to increase screen resolution as for some reason the game didn't register 1920x1080.
Thanks so much.
Can you increase the resolution to 4K, I play at 4K.
