Is dumpster diving really illegal?
Some folks says it is, but i am curious to hear what people here think. Honestly if something is thrown into the trash, its trash anyone should be able to take it. Unless there's a gate that says: no trespassing. I was thinking about dumpster diving at some gamestops and best buys soon

No. generally once trash is set out it becomes public property. Cops use it all the time to gather DNA evidence without a warrant.

Note that this only applies to public property which includes the street curb. It may not apply to private property when the container is still housed within that property or on its premises.

yea i will be careful. i think best buy may be risking it, so i will stick with gamestop and maybe some old computer shops and warehouses. Me, my wife and 2 friends are planning to do it sunday night :) Just for fun, and one time only :)
Laws are different all over. Look it up for where you are, don't ask random people on the interwebs who probably don't even know their own local laws.

I'm 100% sure they are going to say no. I am positive, so it will pointless to even ask. I probably look real foolish going up to a best buy manager asking him: Hello, when you guys closed tonight, can i go through your trash and take whatever i want?
Dumpster diving is legal, except where prohibited by local regulation.

According to a 1988 Supreme Court Ruling (California vs. Greenwood), when a person throws something out, that item is now the public domain.

It was a rhetorical question. The answer means that you probably shouldn't be doing it. Most certainly in my discussion regarding private vs public property, that would lie within private property. I was simply answering your main question which is yes and no.

This. Also, I doubt most poor/homeless people care about the laws, when they live in their situation.
Well It's all good, guess we will see how it goes. :)
What were you hoping to find? Cardboard and packing materials?

Me, computer parts or desktops that nobody doesn't want anymore. My wife, game consoles, my friends, same as me. I have been looking for months though for a place that gives away computers for free or throws them away, i haven't been able to find nobody or no place that does that.

I doubt they would throw those in the trash. They would get fined.

Looking at alot of videos, seems like plenty of people who dumpster dive find alot of computers in the trash though

Actually you can find bags of mostly trash, but with a couple games in a dumpster behind Gamestop, there mostly xbox 360, ps3, wii, psp, and a couple ps2 games, very rarely will you find a xbox one or ps4 game, and not all the cases have games in them as well
