Clean the dust off the CPU cooler. That's usually the cause for high temperature.

Then the cooler must've been installed incorrectly. Did you build it yourself or is it a pre-built? Double check all the hardware is seated correctly.

specs?

post a cpuz validation link
http://www.cpuid.com/softwares/cpu-z.html
cpuz -> validate button -> submit button
it will open a browser, copy the url (address) and paste it here

and temps?

check temps while gaming
use hwmonitor, it logs min/max temps
http://www.cpuid.com/softwares/hwmonitor.html
alt+tab takes long enough for the cpu/gpu to drop 20+c

ALT+Tab is fine as long as the monitoring software is already been running in background; then just look at the Max Temps

some oem software does not log min/max, just shows current

i5-6402P
should not overheat at all
thats a 65w cpu

gtx 960 is a 120w gpu

that should not make any heat at all if the case has any airflow

is it in a cabinet or somewhere with no airflow aroudn it?

actually its in a tight closed space where the back fan is to the wall and the fan for the hard drives is in the front but why would it give me that error and could that be the problem

move it away from the wall so hot air can exit the case

for that cpu, pick up a tx3 or t4
those are cheap and easy to install

It is new and from local store > take it back. Explain the problems. Either get another of the same if you like that, or have it refunded and get something else.

They have to fix the issues, or replace it...

It should not overheat with that CPU and Intel Stock Cooler; those CPU don't even get hot. Most likely the Cooler has come loose. Typical for shipped systems really.
