Upgrading your CPU doesn't make any sense whatsoever, you just gonna end up with the same problem.
The 8350 should have an after market cooler on it anyway the stock coolers are a joke.
Stay away from the FX9xxx because you've already got an FX8350.
Thanks for reply, I think your right, the more I look into the 9 the more it just dosent seem worth it, dam thing just gets to hot for minimal if any preformance gain.
or if you like amd stuff upgrade to a zen setup when it comes.
There are better coolers than Hyper212, for some-what cheap
Such as these:

http://pcpartpicker.com/product/93Crxr/cryorig-cpu-cooler-h7
if its a poor mobo, overclocking or tower cooler can result in lower performance
Say what now? Seriously, you just made that up...
If you have a ♥♥♥♥ mobo that can only pull 100w and you plug in a massive Noctua with 2 fans that pull 25w each, how much does that leave for your CPU?
First off, PC fans don't pull that much ever... most 12 or 14 cm fans are around 0.05 - 0.09 amps; that's approx 0.6 - 1.1 W per fan, and that would be the power at max RPMs too.
And 2nd, the Motherboard never works like that. Fan Headers, USB, they all have their own power. The CPU is by itself in that TDP rating... the Motherboard can pull all the power it wants to from other sources, as needed.
Given your statement, I don't think you even have a clue about how it works.
Simply mount the fan slightly lower so that the air can pass across the vrm heatsink (if the board has any)
If the board lacks vrm cooling completely, the OP should consider adding some small heatsinks.
Its not a massive upgrade anyway, to either the 8370 or the FX9 series, not to mention the fact that there aren't many motherboards out there that can handle the FX9 series either.
A new cooler for your current CPU would fix your overheating issue, my recommendation would be the Cryorig H7, which doesn't often cost a lot more than the 212 evo, yet outperforms it.
Since when ^ ?
I've got the older cm212plus/10xOptima/tuniq tower/vendetta2 all running on amd cpus.
The old tuniq tower 120 with the FX8350 gaming hovers around 40-45c, the 10xOptima is loud with the shark fin fan style and really doesn't cool much better.

.1 diff ^ from the evo but the zalman has to have an 80cfm fan on it.
212evo/H7/10x Optima all hover around each other and all will be more than sufficient to overclock an FX8350 to 4.4ghz no problems.

The H7 ^ is it ball breaking different no ^. Either would do just depends on eithers current pricing.
To say the 212evo is not that great for a stock or overclocked FX8350 is pure exaggeration.
Ps, the 212evo is only $25.
