Edit: the website doesnt seem to have an option for windows8 drivers so i would think windows 7 drivers would work all the same.
As you said, this should not be a hassle and drivers are not needed. It should be a simple plug n' play deal.
I've been using 360 controllers (wired and wireless) with different games and emulators for years with not a single problem. That's why I was leaning towards a defective controller.
It's official xbox 360 controller.
I would try this:
Unplug the controller, open the device manager. Uninstall the driver for the 360 controller - it's under "Microsoft Common Controller". Reboot, then plug in the controller and let Windows install the generic driver again. See if the problem is solved.
If that doesn't work, could you exchange the controller at the store you bought it from?
EDIT: I could be wrong about the location of the controller driver in the device manager, as I'm going off of a PC with a wireless one.

edit: Tested it in Saint's row 3 and 4 and in both games right trigger is working great but then when I get in a car the right trigger (accelerate) works well but left trigger only stops the car instead of causing it to go backwards...come on, I can't be the only one who ever had these problems.
Is there another PC in the house you could try it on? Have you tried a different USB port? Are you using it in a USB 3.0 port perhaps?
I just remembered there is a Windows Update fix that applies to the 360 controller. Plug her in, check for updates and see of there's anything listed under optional downloads.
If none of that helps, I would return it for a new one.
