Depends on how you look at false advertising.
I remember when Steam accidentally had a picture of a Dragon Age/Dragon Age II bundle after DAII was removed, and used it for a deal of the day or something for Dragon Age 1. Totally fine, right? I mean it's just a picture advertising the game, so that can't be construed as false advertising, now can it?
And the way to deal with it is work with the support.
