3D Reals Anthology... Commander Keen
Hey peeps. So I saw the picture of Commander Keen on the advertisments for the 3D realms anthology bundle only to find out that Commander Keen was not included in the bundle .... How do i take this up with steam. Don't really want my money back so much as there are some other good games included, but what made it worth the $30 pricetag was that Keen would be included ....which it is clearly not. False advertising?

And I know that. Because I read it. Long before this topic.

Your point?

Stop presuming...

It is false advertising.
And the way to deal with it is work with the support.

The point is, when doing business - whether making a purchase online, signing a contract, etc. - it's up to a consumer to do his due diligence & read & comprehend what's in front of him & know what he's getting into, as opposed to assuming/inferring outside of what's spelled out. In this case, the store page says that for $29.99 (after a 25% discount), you get 32 3D Realms/Apogee games & goes as far as to list all 32 games. Valve's butt is covered in this case. If you don't bother read & understand what you're either about to buy (or in the case of contracts, sign), then you don't have a proverbial leg to stand on. In this case, it would be one thing if they ACTUALLY SAID Commander Keen was included, but failed to deliver, then the O.P. would have a case, but that isn't true here.

Have you contacted the support?

Rageinator, all you are showing us is that you are in no way educated in consumer affairs. You are partially right in "principal"...but not in fact or law. You presume I didn't read the bundle list, I clearly pointed out that I did, but assumed there were other games not listed BECAUSE game art on the advertising differed from the list. It is not outside the realms of logic that the list might be an featured shortlist. Don't make me bring up the legislation.....

I have lodged the question to steam support through some random avenues and I will let you all know the response,

Cheers

In fairness, buying a game from Steam (or any other service for that matter) is basically a contract. Contracts must be spelled out in detail. In the case of the game bundle in question & it's respective page, The details of the page (price, the list of games, etc.) are the terms of the contract. In this scenario, if the O.P. agreed to the terms by virtue of completing the transaction, He was obligated to pay $29..99 while Valve would be obligated to deliver the 32 games in the list. Valve is obligated to spell out what you get for a given price when selling something. They can't simply truncate a list, list a few games & ending with a "etc."

Not that this would go to court or anything, but hypothetically speaking if it did, this exchange is almost certain to occur, resulting in Valve winning the case:

Valve's Attorney: Did you purchase 3D Realms Anthology from Steam?
O.P.: Yes. I paid $29.99
Valve's Attorney: Did you read the Store page before buying it? [pulls out a printout of the store page] Please show me where it says Commander Keen is included.
O.P.: I didn't read the page. I just looked at a picture. I don't see Commander Keen listed
Valve's Attorney: I rest my case, Your Honor. No further questions.

Now that I had a moment to think (& with my last post in mind) as well as the fact that some people are focusing on the picture on the page alone, consider this: Duke Nukem is in that picture too. While there are some Duke Nukem games in the bundle (4, specifically), the bundle does not include Duke Nukem Forever & Duke Nukem: Time to Kill & those games aren't mentioned in the list. If your arguments held any water, you could argue that you're owed Duke Nukem Forever & Duke Nukem: Time to Kill because you see him in a picture. Of course, this won't hold up in court either. Ultimately, what is written in text, spelled out in detail, is what's important here.

https://www.accc.gov.au/consumers/misleading-claims-advertising/false-or-misleading-claims

"Businesses are not allowed to make statements that are incorrect or likely to create a false impression.

This rule applies to their advertising, their product packaging, and any information provided to you by their staff or online shopping services"

It's very different from a business contract. If hypothetically it did go to court (very hypothetical) I would most definitely win.

Enlighten me, oh king of all legal matters .... quote the statement that is incorrect or likely to create a false impression on the 3D Realms Anthology page?

Seems like very straight forward statements that are in no way misleading. Says nothing about Commander Keen

""This rule applies to their advertising, their product packaging, and any information provided to you by their staff or online shopping services""

Dude, I Can't post the picture but Commander Keen is front and center of their online bundle packaging. Not sure why you are confused, doubt you actually are.

Dude... Forget... the... picture! Get... over... it! You're a little obsessed with the picture. READ! What I posted last is the packaging/advertising with all of their statements about the product. AGAIN, NO STATEMENTS WERE MADE IN ANY WAY ABOUT COMMANDER KEEN.

Mate, I've put it to you in English, others have given you precedence, I've even provided you a legal source. in the near future I expect to receive a reply. Lets see where the chips fall.

Look, I've been speaking to you in english, & I've even been using small words so any moron could understand, and Steam is in English too. It isn't too hard to read the game's store page with a little reading comprehension. It is not misleading in any way, shape, or form despite the fact that you obviously desperately want it to be misleading. Simply put, pay $29.99 and you get the 32 games that they list. What part can you not comprehend? You CAN read, can't you?
No one special '77 6 mai. 2015 às 6:44
Oh, and here's a little reading for you... this is the store page for Commander Keen. If you care to notice, Commander Keen is an id game, NOT AN APOGEE/3D REALMS game like the games in the 3D Realms Anthology bundle. And in as far as that picture that you're ever so fond of bringing up, look again... that is NOT Commander Keen.

3D Realms Anthology: http://store.steampowered.com/sub/61948/

**EDIT**: I just looked up some more reference info for you. I suggest reading it. http://en.wikipedia.org/wiki/Commander_Keen

To quote Gene Wilder's character in the original Willy Wonka movie... "You lose! You get nothing! Good day sir!"
