Do you actually have any proof that it's a spyware? :/ It's pretty much the universal tool for PS3 gamepad users.
It's as much spyware then Chrome is.
There will always be people that call something "Spyware" when in reality its not. Origin and uplay are still being called spyware.

I don't consider "a web tool that runs with kernel privileges that can run arbitrary code from the Internet from a chinese website" to be anything other than spyware.
Yes if you 'dont use the terrible web tool' then you can avoid this. But really who is doing that? I'd wager at least 50% of people (and that's CONSERVATIVE) are running that native motioninjoy web tool. Which means they'er all vulnerable to whatever whimsical thign the developer, or any potential website hijacker wants to do. IT's basically a gamer bot-net waiting to be activated.
Since 'most' people won't run the MotionInJoy properly by ripping out the spyware component, I highly discourage people to use it. Its more or less like telling people blowfish is totally safe for sashimi, as long as you deal with the 'minor' problem of getting rid of that poison sack thing.
Chrome can't download and execute arbitrary code from the internet with kernel priviledges without your permission like MotionInJoy can.
uPlay and Origin were overblown concerns.
There are REAL LEGITIMATE problems with MotionInJoy that people seem to not know about, or don't care as long as they can get their PS3 controllers working. I don't consider installing a Chinese Trojan on my computer to be an acceptable compromise just to get a controller working.
Basically with Inbound blocked it won't be able to receive any sort of data but can still reach out to the internet.
Motion in Joy works great.
